Litigation Support Services
What
is litigation Support:
Our Litigation
Support services assists attorneys in each phase of a legal
case, from discovery to decision. Medical litigation support
provides the attorney with the information needed to thoroughly
understand a medical case and also supplies the attorney with medical/legal
expertise to litigate a case. Litigation support may be provided
by the attorney’s staff or by out-sourcing to a Legal Nurse Consultant.
In either situation, it is important that the attorney understand
the medical issues presented.
A
legal nurse consultant is an advocate for an attorney’s medical/legal
case and becomes an integral part of the defense team. This professional
is trained and is able to provide an objective opinion in the medical
development of a case. A legal nurse consultant uses his/her R.N
.background to analyze cases for merit. Through medical, legal and
nursing research, a legal nurse consultant applies the standard
of care to each case and advises the attorney to any variances from
the standard of care. The LNC is capable of developing strategy
for a case and identifying strengths and weaknesses. Most importantly,
the LNC becomes the liaison between the attorney, expert witness
and other healthcare professionals. The LNC has the experience to
analyze and interpret medical records, and can ultimately testify
as an expert in a case. A LNC is cost-effective and utilizes their
experience to the benefit of an attorney.
Medical
Records Review delivers a thorough understanding of the medical
aspect of a case. This is achieved through extensive research, collection
and organization of medical records, chronology of medical treatment
and an explanation of the issues of the case. A medical records
review is one important facet to the attorney’s preparation of a
case and often times the information derived from a medical records
review is a key factor in an out of court settlement. The process
of collecting, analyzing and reviewing medical records by an independent
legal nurse consultant is a time saving factor for the attorney
and his staff. Medical Records Review pinpoints the medical issues
of a case and defines the complex health questions which are foreign
to most attorneys.
